Terms of Service
REGISTRATION REQUIREMENTS
Pulaski Networks will not register any
Internet account to any person or persons
under the age of 18. Persons under the
age of 18 wishing to access the Internet
through Pulaski Networks must do so
under the supervision of their parent or
legal guardian using their account.
PRIVACY STATEMENT
Pulaski Networks will not, except by court
order, divulge any information about it's
customers to any party other than the
primary holder or his designated
representative. Pulaski Networks will not
accept any account changes from any
party other than the primary account holder
or his designated representative.
LOCAL ACCESS
Pulaski Networks offers it's services in
select areas only. It is the customers
responsibility to ensure that their computer
is dialing the correct access number for
their area. Pulaski Networks shall not be
held responsible for any toll charges
incurred by it's customers.
If you are unsure if there will be any toll
charges for the use of any of our access
numbers, please consult your local
telephone company and/or long distance
carrier.
PROVISIONING OF SERVICES
Pulaski Networks will provide computing
and Internet services in exchange for
payment of fees as published on their
Internet Web Site.
Pulaski Networks may provide computer
software and/or setup instructions with
their services. This software is provided as
a courtesy to our users and does not
provide a warranty, expressed or implied,
as to the behavior or usability of this
software. Pulaski Networks shall not be
held responsible for damages, real or
otherwise, made to the customers
computer from the use of this software.
Pulaski Networks will, to the best of it's
ability, provide assistance for configuration
and connection issues, directly related to
your account with Pulaski Networks, with
supported software on supported computer
operating systems. Assistance with
unsupported software packages or
computer operating systems may be
furnished by Pulaski Networks at their
standard consulting rates as posted on
their Internet Web Site.
Pulaski Networks maintains dialup access
equipment supporting the V.90 analog
modem protocol. Actual connection
speeds may vary between 9600bps and
52000bps depending on the public
switched telephone network, environmental
factors, modem brand and condition, and
physical condition of the customers
in-home telephone wiring.
ACCOUNT LIMITATIONS
Pulaski Networks provides a wide variety of
accounts. These accounts are designed to
be used by a single individual from a single
computer at any one time. Simultaneous
usage by multiple persons, or usage by
persons not in the immediate family or
business office of the account holder is not
allowed and may result in the immediate
termination or suspension of the
customer's account.
Pulaski Networks requires that all
computers be attended while connected to
Pulaski Networks. Unattended and/or idle
connections will be subject to
disconnection after a period of 20 minutes.
Failure to attend a computer while it is
connected to Pulaski Networks may result
in the immediate termination or suspension
of the customers account.
At no time, may any customer operate a
server of any sort while connected to
Pulaski Networks. A server is defined as
any software package that is primarily
used to allow other persons or entities, the
client, to connect and transfer data from
the server to the client's computer. This
includes such software applications as
Kazaa, IMesh, Direct Connect, Microsoft Personal Web Server,
War FTPd, or any other software designed
to aid in the distribution of files. If the
customer requires such service, he/she may
purchase those services at the rates
published on Pulaski Networks' Internet
Web Site.
ACCEPTABLE USAGE
Pulaski Networks forbids the sending of
spam to any public forum or private email
address. Spam is defined as any unwanted
or unsolicited bulk email, commercial or
otherwise. Customers who use their
account to engage in the practice of
spamming will be subject to immediate
termination and will be fined at a rate of
$20 per recipient per message.
Pulaski Networks, LLC. provides electronic
storage space to its customers for the
purpose of publishing private and
commercial information. The customer is
solely responsible for the content of their
publications and agrees to abide by local,
state, federal, and international law.
ACCOUNT TERMINATION
Pulaski Networks reserves the right to
terminate any account for any reason
without regard to race, religion, sex,
physical ability, or other factor.
Upon account termination, Pulaski
Networks will refund any unused monies
prorated against the standard monthly rate
as posted on the Pulaski Networks Internet
Web Site. No partial months will be
refunded under any circumstances.
Accounts in a suspended state for more
than 60 days will be subject to termination.
In the event of an account termination for
any reason, all customer email, web sites,
or other electronic information will be
subject to immediate and unrecoverable
deletion.
BILLING POLICY
DISCLOSURE: Pulaski Networks requires
all customers to provide current and
accurate billing information including
names, addresses, phone numbers, and
preferred billing method. The customer is
also responsible for reporting any and all
changes to their billing information
including credit card and/or bank
information. Pulaski Networks is not
responsible for any damages, financial or
otherwise, which may have been caused
due to misrepresentation of information or
by failure to provide current and accurate
billing information.
PAYMENT DUE DATE: Payments are
due, in full, by the first day of each billing
cycle. All accounts are billed in advance of
the anniversary of the date the account
was created. Irresolvable anniversary dates
will be adjusted on an individual basis to
the last day of the month.
DELINQUENT PAYMENTS: Accounts not
paid in full within 5 days of the due date
will be subject to a $10.00 late fee and/or
account suspension.
RETURN CHECK POLICY: Checks
returned for any reason will be subject to a
$50 processing fee. Failure to respond
immediately to a returned check may
result in the immediate suspension of the
customer's account.
REFERRALS: Processing of referral
bonuses will occur each business day
before regular billing is processed. Referral
bonuses are not active until 20 days after
the creation of the new customer's
account. All referral bonuses are subject to
review by Pulaski Networks. Pulaski
Networks reserves the right to terminate
the referral program at any time for any
reason for any customer or customers.
THIRD PARTY NETWORK SERVICES
While using Pulaski Networks' services to
access third party networks, the customer
agrees to abide by the posted and inferred
rules of the third party network. Unlawful or
intrusive access is strictly prohibited and
includes, but is not limited to attempting to
penetrate security measures, port
scanning, launching of Denial of Services
attacks, whether or not the intrusion
results in the loss or damage of data. Such
activities will result in the termination of
services and/or legal action.
Pulaski Networks, LLC. reserves the right
to block information including, but not
limited to email, web sites, and
newsgroups, from domains and sites which
have been deemed an unacceptable risk
due to spamming of Pulaski Networks or
with a history of spam originating from said
sites or domains, until such time as the
originating sites implement measures to
cease outgoing spam.
INDEMNIFICATION
PULASKI NETWORKS, LLC. PROVIDES
INTERNET SERVICES ON AN 'AS-IS,
AS-AVAILABLE' BASIS. NO
WARRANTIES, EXPRESSED OR
IMPLIED, INCLUDING, BUT NOT LIMITED
TO, THOSE OF THE MERCHANTABILITY
OR FITNESS FOR A PARTICULAR
PURPOSE, ARE MADE WITH RESPECT
TO PULASKI NETWORKS, LLC. OR ANY
INFORMATION OR SERVICES THEREIN.
THIS NO WARRANTY EXPRESSLY
INCLUDES ANY REIMBURSEMENT FOR
LOSSES OR INCOME DUE TO
DISRUPTION OF SERVICE BY PULASKI
NETWORKS, LLC., ITS OFFICERS,
EMPLOYEES, OWNERS, AGENTS,
SHAREHOLDERS, OR VENDORS.
THE CUSTOMER AGREES TO ACCEPT
RESPONSIBILITY FOR ANY AND ALL
DAMAGES, REAL OR OTHERWISE,
INCURRED THROUGH THE USE OF THE
CUSTOMER'S ACCOUNT BY THE
CUSTOMER OR ANY THIRD PARTY.
COMPLETE AGREEMENT & AMENDMENT
These terms and conditions supercede all
previous representations, understanding, or
agreements and shall prevail
notwithstanding any variance with terms
and conditions of any order submitted.
Pulaski Networks, LLC. reserves the right
to amend, alter, or modify the Terms Of
Service at any time and in any way. Any
amendment, alteration, or modification is
effective immediately upon posting on
Pulaski Networks' Internet Web Site.
Use of Pulaski Networks' services
constitutes acceptance of these current
terms and conditions. Violations of any
provisions contained herein may result in
immediate termination of service with no
refund. Pulaski Networks, LLC. reserves
the right to pursue legal action for any
damages incurred from violations of these
policies.
